Supervision of charges and tariffs

We ensure that railway charges comply with the provisions of current legislation. ADIF and ADIF Alta Velocidad must submit a proposal for charges to us, which must also be subject to consultation with railway companies. We verify that the proposal complies with the regulations, for which we may conduct audits of infrastructure managers to understand the costs underlying the provision of services.

Additionally, the community regulation also grants us functions in analyzing cost models directly attributable to railway services. Regarding the railway charges incentive system provided for in Order FOM/189/2015, in addition to resolving any conflict arising from its application, we decide on the basic parameters of the system in case there is no agreement between the infrastructure managers and the railway companies. We also have a representative on the monitoring committee of the incentive system.

Regarding service facilities (which are very diverse infrastructures, from maintenance workshops to freight terminals and passenger stations), we supervise that access tariffs to them and the services provided in them are cost-oriented plus a reasonable profit.

Verification of OSP prices

We supervise compliance with accounting obligations by railway operators of passenger services that provide services under public service obligations (OSP). The Railway Sector Law requires these operators to maintain separate accounting for OSP services and other commercial services, in order to avoid cross-subsidization between them.
