CNMC is investigating possible anti-competitive practices in the market for the provision of roadworthiness testing services for commercial vehicles. The practices may have included the distribution and manipulation among companies in the sector of tenders called by the Directorate General of Traffic (DGT).  

On 11 and 12 September, inspections were carried out at the headquarters of several companies operating in this market. These inspections are part of the investigation opened by CNMC following the provision of information by the Directorate General of Traffic on 28 June 2018, in accordance with the twenty-third additional provision of Royal Legislative Decree 2/2011 approving the consolidated text of the Public Sector Contracts Act. This investigation has been initiated due to possible anti-competitive collusive practices being carried out by certain companies in the sector in relation to tenders called by the DGT for the provision of roadworthiness testing services for commercial vehicles throughout Spain. 

The inspections are a preliminary step in the investigation of alleged anti-competitive practices and do not prejudge the investigation’s outcome or the culpability of the inspected companies. If, as a result of the inspections, evidence of practices prohibited by the Defence of Competition Act is found, disciplinary proceedings will formally commence.

Agreements between competitors constitute a very serious infringement of competition legislation, and may result in fines of up to 10% of a company's total turnover.
