The General Telecommunications Law (LGTel), in its article 69, grants the CNMC the authority to require providers of internet access services and publicly available interpersonal communication services to publish complete, comparable, reliable, easily accessible, and updated information about the quality of their services.

The publication of evaluable, reliable, and relevant quality parameters for consumers is undoubtedly beneficial for competition, as it allows users to make purchasing decisions with a higher level of information.

Technologies and commercial offers relevant to measure:

The measurement system only includes the obligation to publish data related to transmission speed, latency (*), jitter (*), and packet loss (*) for those technologies considered relevant for the residential market, which meet the following criteria:

Individually considered, that are used by at least 10% of the total users of Internet access services, as well as
All those belonging to the group of most used technologies that, considered as a whole, include at least 85% of the total users of Internet access services.

For these purposes, according to the data provided by the operators, the relevant technologies that must be considered by the measurement systems for the Internet access service are as follows:

Access based on FTTH
Access based on LTE
Access based on 5G (*)

(*) In the implementation phase.

Additionally, within the technologies of the fixed Internet access service, the most representative commercial offers (speeds) are measured from the perspective of the residential retail market, being those that:

All those commercial offers (based on their speeds) that, individually considered by each obligated operator, represent more than 10% of their active residential customers to whom the operator offers services using the technologies considered relevant.
All those commercial offers (based on their speeds), additional to those considered in the previous point, until the total number of customers of the services under testing accounts for at least 85% of the total residential customers that the operator serves using the technologies considered relevant in the measurement system.

Currently, depending on the volume of customers who have contracted said speed with each of the operators obligated to publish their quality parameters, the commercial offers of the Internet access service that are published are as follows:

Fixed Internet access service
